E&O claims examples

The work may be finished. The professional allegation is not.

These fictionalized scenarios illustrate questions—not guaranteed coverage. The actual policy and facts control.

REAL ESTATE

Permitted use was misunderstood.

A buyer alleges the agent represented that a property could be used for a particular business, but local restrictions prevent it. The buyer seeks transaction and relocation costs.

INSURANCE AGENCY

The requested endorsement was never issued.

After a loss, a client alleges the agency failed to add a location and requested coverage. Emails, applications, carrier instructions and the policy timeline become critical.

DESIGN PROFESSIONAL

A drainage calculation is challenged.

A project owner alleges an engineer’s design contributed to water damage and costly corrective work. Professional standard of care, causation and contract terms are disputed.

TECHNOLOGY

A migration interrupts operations.

A client alleges data was corrupted and its system remained unavailable longer than promised. The E&O, cyber and contract provisions must be compared.

CONSULTANT

A recommendation does not deliver the projected result.

The client claims it relied on inaccurate analysis and lost revenue. The consultant disputes both negligence and the claimed damages.

PROPERTY INSPECTOR

Water damage appears after closing.

The buyer alleges that visible evidence should have been reported. The engagement agreement, photographs, report limitations and condition at inspection are reviewed.

PROPERTY MANAGER

A repair request falls through the process.

An owner alleges delayed vendor coordination allowed damage and tenant disruption to increase. Professional, general liability and property questions may overlap.

MARKETING FIRM

A campaign allegedly violates another party’s rights.

A client seeks defense and reimbursement after receiving a demand involving campaign content. Media, professional and contractual-liability terms may all matter.

Why even a defensible claim matters

Professional disputes often require lawyers and industry experts before responsibility or damages are resolved. Whether defense costs sit inside or outside the limit can materially affect the protection remaining for settlement or judgment. Prompt notice is essential when a demand, subpoena, complaint or circumstance could meet the policy definition of a claim.
