Product liability starts with the supply chain
Describe products, end uses, customer industries, countries of origin, labels, warnings, testing, quality control and contractual indemnity. Importers may be treated as the responsible domestic party when a foreign manufacturer is difficult to pursue.
Property and equipment
Replacement values for machinery, stock, raw materials, tenant improvements and buildings should be reviewed alongside equipment breakdown and business income. A specialized machine may take far longer to replace than ordinary office property.
Recall and contamination
General Liability does not automatically cover every cost of withdrawing a product. Product recall, contamination or errors and omissions coverage may be available for qualifying operations, subject to underwriting.
Transportation and warehousing
Determine who owns goods in transit, who arranges freight and when title transfers. Cargo, warehouse legal liability, inland marine and commercial auto exposures can depend on the contract and actual practice.
