What a policy generally addresses
Workers’ Compensation can provide statutory medical and income benefits for covered work injuries. Employer’s Liability can respond to certain employee-injury suits not handled by the statutory benefits, subject to the policy.
The Texas decision deserves care
Many Texas private employers are not required to carry Workers’ Compensation. A nonsubscriber may lose important common-law defenses and face an employee lawsuit after a serious injury. Alternative occupational accident arrangements are not the same as statutory Workers’ Compensation.

Build payroll by classification and state
Prepare estimated payroll by job duty, state and ownership status. Clerical employees, outside salespeople, drivers, field technicians and construction crews may fall into different classifications. Owners may have inclusion or exclusion choices that vary by entity type and state.
Experience modification and loss control
For eligible employers, the experience modification factor compares loss experience with expectations for similar businesses. Claim frequency, return-to-work practices, payroll accuracy and reserve development can affect future cost. A written safety program is most useful when it reflects the work employees actually perform.
Multi-state operations
Hiring employees, opening a location or sending crews into another state can create insurance and compliance questions. Tell the agency before work begins in a new jurisdiction so the policy information and available options can be reviewed.
Audit preparation
Workers’ Compensation is commonly audited. Keep payroll records, overtime detail, job descriptions, subcontractor certificates and state allocations organized throughout the policy year.
